Ms. Amani and her husband, Mr. Carlos, faced a unique challenge when it came to proving their relationship and marriage. Due to societal and cultural pressures, as well as religious restrictions in their home country of India, they were unable to have a traditional marriage ceremony and were living together secretly. Earnest Immigration and Citizenship recognized their difficult situation and helped them provide alternative forms of evidence to prove their genuine relationship and marriage.

Earnest Immigration and Citizenship used the Spousal Open Work Permit application under subparagraph 205(c)(ii) of the Immigration and Refugee Protection Regulations (IRPR), LMIA Exemption code C42, to help Ms. Amani see her husband in Canada. The application was made as the spouse of a study permit holder, as Mr. Carlos was pursuing full-time studies in Ontario at Conestoga College. Ms. Amani was financially independent and provided all the relevant documents.

With their help, Ms. Amani was able to convince IRCC about the genuineness of their relationship. Ms. Amani got her Spousal Open Work Permit within 8 weeks after filing her application with IRCC and she finally reunited with her husband in Canada. Being reunited through the Spousal Open Work Permit undoubtedly had a positive effect on the couple’s emotional well-being and allowed them to continue building their relationship. It also provided them with the opportunity to live together as a public-facing couple, without fear of persecution or harm, and to enjoy a fulfilling married life. The Spousal Open Work Permit provided Ms. Amani with the opportunity to work in Canada, which would have contributed positively to the couple’s financial stability and quality of life.
