We were approached by a young couple in distress in 2022. They had been misguided by a big law firm and handed over a PR refusal. It was a simple case, complicated by the incompetencies of another law firm. When the couple came to us, we reassessed their situation and prepared for a reapplication. We had to act on priority as they faced expiring work permits.
We prepared a strong application and went through the re-application process. It is imperative to mention, the couple had more than 3 temporary residence refusals each from the past and 1 PR refusal.
Fortunately, their profile was picked up again from the pool of applicants, and we reapplied for their permanent residency.
The wife, who was the principal applicant, on file, received the approval of her PR. It took IRCC 5 months to give this approval. Meanwhile, the husband’s work permit expired, and he had to exit the country. He waited patiently in Egypt, his home country, for applications to be finalized. The real turmoil started after the PR was approved.
Post approval of PR, The IRCC glitched in sending further instructions (final paperwork) to the principal applicant, that is, the wife in Canada. We knew the PR was approved as we could see on our portals, but IRCC was not sending the landing papers. Without this confirmation of PR for the wife, the husband’s PR process could not be completed. He waited and waited, away from his wife.
The wife was alone, diagnosed with borderline autism and without a job, barely surviving. She was emotionally and physically broken, due to a small error/delay from IRCC.
Team Earnest had promised when we retained her that we would be with her till the end of the journey, that is getting her and her husband’s PR, not just application submission.
And we did, we regularly took up her case with IRCC and also approached the local MP office, trying every possible remedy in law to get her the PR sooner than later.
And finally, after an ordeal of 6 months, countless emails, requests we received the instruction for the spouse in Canada, and we could complete their PR process.
