CUSMA Professional Work Permit: How US Citizens Work in Canada Without an LMIA

The CUSMA Professional work permit is the most US-specific work route Canada offers. If you are a US citizen with a Canadian job offer in a listed profession, it lets you work here without an LMIA — often with a decision the same day at the border.

NAFTA → CUSMA: What Actually Changed

The North American Free Trade Agreement was replaced by the Canada–United States–Mexico Agreement on 1 July 2020. In the United States the same agreement is known as the USMCA, which is part of why the terminology is still tangled five years on.

For work permits, less changed than the rebrand suggests. The professional category — the list of occupations, the credential requirements, the LMIA exemption — carried over substantially intact. That is why searches for “NAFTA work permit Canada” are still common, and why officers and employers sometimes use the old name too. If someone offers you a NAFTA work permit today, they mean this one.

ELIGIBILITY

Who Qualifies

Four conditions have to hold at once. Missing any one of them takes you out of this category entirely.

US or Mexican Citizenship

CUSMA Professional status is open to citizens of the United States and Mexico only. US permanent residents — green card holders — do not qualify, however long they have lived there.

A Profession on the CUSMA List

Your occupation must appear on the agreement’s list of professionals, which carried over from NAFTA. It covers roughly sixty occupations, including engineers, accountants, computer systems analysts, scientists and several healthcare roles.

The Required Qualifications

The list sets the credential for each profession — usually a specific degree, sometimes a licence or a set number of years of experience. Meeting the job description is not enough on its own.

Pre-Arranged Employment

You need a job offer from a Canadian employer before you apply. The work must fall within the listed profession, and you cannot use CUSMA to be self-employed in Canada.

Documents You Will Need

A Detailed Job Offer Letter

From the Canadian employer, setting out your job title, a description of the duties, the professional category you are being admitted under, the duration of the work and your remuneration.

Proof of Your Credentials

Your degree, diploma or professional licence — whatever the CUSMA list requires for your profession — plus transcripts or an equivalency assessment where a foreign credential is involved.

Proof of Citizenship

A valid US or Mexican passport. A green card, a driver’s licence or a birth certificate alone will not establish eligibility for this category.

Supporting Evidence

A résumé, reference letters and any professional registration. Bring originals or certified copies if you are applying at a port of entry.

WHERE TO APPLY

Port of Entry or Online

US citizens have a choice most applicants do not. You can request the permit at a port of entry when you arrive, and walk away with a decision the same day. Or you can apply online before you travel and arrive with the permit already approved.

The port of entry route is faster, but it is decided in one pass by the officer in front of you. If a credential is ambiguous, if your job offer letter does not clearly map your duties to a listed profession, or if you have any prior refusal or inadmissibility, an online application gives you room to present the case properly — and a refusal at the border is a bad place to discover a problem.

Duration, Extensions and Family

Initial Permit

A CUSMA Professional work permit is commonly issued for up to three years, tied to the employer and the profession named in your application.

Extensions

Extensions can be granted in further increments of up to three years. There is no fixed lifetime cap, but the work must remain genuinely temporary — repeated renewals invite scrutiny about intent.

Your Family

A spouse or common-law partner may be eligible for an open work permit, and dependent children can generally study. Spousal open work permit rules were tightened recently and now depend on your occupation’s TEER category and how long your permit has left, so confirm eligibility before you count on it.
